These Terms of Use (“Terms”) govern your use of:
– the Swim Success mobile applications available on the Apple App Store and Google Play Store (“Apps”); and
– the Swim Success website and related online services (“Site”).
Together, the Apps and Site are referred to as the “Services.” The Services are owned and operated by A A Swimming Pte. Ltd., registered in Singapore (UEN 202245655R) with its office at 114 LAVENDER STREET, #09-56, CT HUB 2, SINGAPORE (338729) (“Swim Success”, “we”, “us”).
By downloading, installing, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 13 years old to use the Services. If you are under 18, you confirm you have consent from a parent or guardian. We may suspend or delete accounts that do not meet these requirements.
Swim Success provides personalized swim training programs, workouts, educational content, and related features, including optional video stroke analysis where you submit a video for feedback.
We may modify, suspend, or discontinue any part of the Services at our discretion.
We may release updates to the Apps to improve features or fix bugs. You agree to install updates to continue using the Apps.
Use of the Apps is also subject to:
Apple Media Services Terms and Conditions if you use iOS;
Google Play Terms of Service if you use Android.
These stores are not responsible for the Apps, their content, or support.
Swim Success is not a medical or healthcare provider. All workouts, plans, and advice provided through the Services are for informational and educational purposes only.
You should consult a qualified physician before starting any exercise program, particularly if you:
– have heart, respiratory, joint, or bone conditions;
– are taking medications that affect exercise;
– are not confident in your ability to swim safely.
Never disregard professional medical advice because of something you read or view in the Services. Using Swim Success does not create a doctor-patient relationship.
If you submit a video for stroke analysis:
– You retain ownership of your video.
– You grant Swim Success a limited license to store, view, and use the video solely to provide you with feedback.
– We do not share or publish your videos without your explicit consent.
– You are responsible for ensuring the video does not contain content that is unlawful, offensive, or infringes on the rights of others.
You agree not to:
– copy, modify, reverse engineer, or distribute any part of the Services;
– use the Services for illegal purposes;
– interfere with or attempt to disrupt the Services;
– upload harmful, offensive, or infringing content.
The Services are licensed to you for personal, non-commercial use only.
– We may offer a free trial (e.g., 1 month or 7 days) as specified in the Apps. Free trials are for new users only.
– After the free trial, you will be charged the subscription price shown at sign-up (monthly or annual).
– Payments are processed by the Apple App Store or Google Play Store. You manage your subscription, including cancellation, directly through your store account.
– Subscriptions automatically renew unless you turn off auto-renew at least 24 hours before the renewal date.
– Subscription prices, durations, and terms are displayed in the App Store or Google Play Store at the point of purchase and may vary by region.
– No refunds are offered except where required by law.
All content in the Services (workouts, videos, designs, trademarks, logos, software) is owned by Swim Success or its licensors. You may not copy, use, or exploit this content without permission. You may not use our trademarks, branding, or name without prior written consent.
The Services are provided “as is” and “as available.” We make no guarantees that the Services will be error-free, uninterrupted, or meet your expectations.
To the fullest extent permitted by law, Swim Success disclaims all warranties, express or implied, including fitness for a particular purpose.
To the maximum extent permitted by law:
– Swim Success is not responsible for any injury, accident, or damage that occurs while following workouts or using the Services.
– You assume all risks associated with swimming and exercise activities.
– Our total liability to you will not exceed the greater of: (a) SGD $100, or (b) the amount you paid us in the 12 months prior to the claim.
You agree to indemnify and hold harmless Swim Success and its officers, employees, and partners from any claims, damages, or expenses arising from:
– your breach of these Terms, or
– your misuse of the Services.
We may suspend or terminate your access to the Services if you breach these Terms. No refunds will be provided in such cases including if your access is terminated for violation of these Terms.
These Terms are governed by Singapore law.
If a dispute arises, you agree to first attempt to resolve it through mediation with us in good faith before taking further legal action.
Any disputes will be subject to the exclusive jurisdiction of the courts of Singapore.
We may update these Terms from time to time. The updated version will be posted on our Site and Apps with a new “Last updated” date. Continued use of the Services means you accept the new Terms.
