1. Enrollment and Registration

1.1. Participants must provide accurate and complete information during the registration process.
1.2. Enrollment is subject to availability and may be limited based on class size and instructor availability.
1.3. Participants must meet the minimum age and skill requirements for the respective swimming programs.
1.4. AA Swim School reserves the right to accept or reject any enrollment application at its sole discretion.

2. Weather Policy

2.1. Swimming lessons will generally proceed as scheduled, regardless of weather conditions, unless determined unsafe by AA Swim School.
2.2. In the event of thunderstorms, heavy rain, lightning, or any other hazardous weather conditions, AA Swim School may cancel or reschedule swimming lessons.
2.3. If a swimming lesson is canceled due to weather conditions, AA Swim School will make arrangements for make-up lessons or provide refunds as follows:
a. Make-up Lessons:
i. Every effort will be made to schedule a make-up lesson at a mutually convenient time for the affected participants.
ii. Make-up lessons may be offered on an alternative day, time, or at a different venue, depending on availability.
iii. Participants will be notified of the make-up lesson details via email, text message, or phone call.
b. Refunds:
i. If a make-up lesson cannot be scheduled or the participant is unable to attend the make-up lesson, a refund for the canceled lesson may be provided.
ii. Refunds will be processed according to the School's refund policy and may take a reasonable period to complete.
2.4. AA Swim School will make reasonable efforts to notify participants in advance via email, text message, or phone call about any lesson cancellations or changes due to weather conditions.
2.5. If a swimming lesson is canceled due to weather conditions and the coach has already arrived at the lesson venue, the coach will conduct a dryland session appropriate for the age of the swimmer(s) instead.
2.6. The dryland session will focus on exercises, drills, or activities that are relevant to swimming development and suitable for the indoor or sheltered environment.
2.7. No make-up lessons or refunds will be provided for swimming lessons that are transformed into dryland sessions due to weather conditions.

3. Membership and Payment

3.1. AA Swim School offers a membership-based payment system for swimming lessons, similar to a monthly subscription.
3.2. Participants can choose to become members of AA Swim School by enrolling in the membership program.
3.3. As members, participants will have access to a certain number of swimming lessons per month based on their chosen membership plan, typically four lessons per month.
3.4. The membership fee will be charged on a recurring monthly basis, starting from the date of enrollment.
3.5. The membership fee covers the predetermined number of swimming lessons included in the selected membership plan.
3.6. In the event that a particular month has an extra week due to the calendar, resulting in a fifth lesson, participants will be charged accordingly for the additional lesson.
3.7. The fees for the extra lesson will be communicated to participants in advance, and payment must be made for the additional lesson along with the regular monthly fee.
3.8. Participants must provide valid payment details during the enrollment process to authorize recurring monthly payments.
3.9. Payment for the membership fee will be automatically deducted from the participant's chosen payment method on a monthly basis.
3.10. Participants will receive an invoice or receipt for each successful payment made towards their membership.
3.11. Changes to the membership plan, including upgrading, downgrading, or canceling the membership, can be requested by contacting AA Swimming School.
3.12. It is the participant's responsibility to notify AA Swimming School of any changes to their payment details to ensure uninterrupted membership and lesson access.
3.13. AA Swim School reserves the right to modify the membership fees and plans with prior notice to the members.

4. Refund Policy

4.1. Refunds for swimming lessons will be provided according to the following guidelines:
4.1.1. If a participant cancels enrollment before the start of the swimming program, a refund may be provided, subject to an administrative fee determined by AA Swim School.
4.1.2. No refunds will be provided for participant-initiated cancellations once the swimming program has commenced.
4.1.3. In the event of unforeseen circumstances or medical reasons that prevent a participant from continuing swimming lessons, a pro-rata refund may be considered upon submission of appropriate documentation.
4.1.4. Refunds will be processed within a reasonable timeframe, typically within 30 days from the date of the refund request.
4.2. AA Swim School reserves the right to modify the refund policy at its sole discretion. Any changes to the refund policy will be communicated to participants in advance.
4.3. For online courses, refunds are available within 30 days of purchase. To request a refund, individuals can contact us at info@aaswimschool.com. We aim to process refunds promptly, typically within 30 days from the date of the refund request.

5. Liability and Waiver

5.1. Participants and their legal guardians acknowledge that swimming involves inherent risks, and AA Swim School will not be held liable for any injury, loss, or damage incurred during swimming lessons.
5.2. Participants and their legal guardians agree to release, indemnify, and hold AA Swim School and its instructors, employees, or agents harmless from any claims, liabilities, or expenses arising from participation in swimming lessons.
5.3. Participants and their legal guardians must comply with all safety rules and instructions provided by AA Swim School and its instructors.

6. Amendments

6.1. AA Swimming School reserves the right to modify these terms and conditions at any time without prior notice.
6.2. Any changes to these terms and conditions will be effective upon posting the updated version on AA Swim School's website

7. Photography and Social Media Policy

7.1. AA Swimming School may take photographs or videos of participants during swimming lessons for promotional and marketing purposes, including but not limited to use on our website, social media platforms, and printed materials.
7.2. By enrolling in our swimming school, participants and their legal guardians grant AA Swim School the right to use such photographs or videos without any compensation or approval.
7.3. AA Swim School will make reasonable efforts to ensure that photographs or videos are used in a respectful and appropriate manner.
7.4. If participants or their legal guardians do not wish for photographs or videos featuring themselves or their child to be used by AA Swim School, they must notify us in writing prior to the commencement of swimming lessons.
7.5. Participants and their legal guardians understand that AA Swim School cannot control the use of photographs or videos taken by other individuals and shared on social media platforms. AA Swim School shall not be held liable for the use or misuse of such photographs or videos by third parties.

8. Safety and Code of Conduct:

8.1. Participants are required to follow all safety instructions and guidelines provided by the instructors and staff of AA Swimming School.
8.2. Participants must conduct themselves in a respectful and appropriate manner towards instructors, staff, and fellow participants.
8.3. Any behavior that endangers the safety or well-being of others, including bullying, harassment, or disruptive conduct, will not be tolerated and may result in the participant's dismissal from the swimming program.

9. Health and Medical Conditions:

9.1. Participants or their legal guardians are responsible for notifying AA Swim School of any relevant medical conditions, allergies, or disabilities that may affect the participant's participation in swimming lessons.
9.2. It is the participant's responsibility to ensure they are in suitable physical condition to participate in swimming lessons. Participants with specific health concerns should seek medical advice before enrolling.
9.3. AA Swim School reserves the right to refuse participation or request additional medical documentation if necessary to ensure the participant's safety.

10. Parental/Guardian Responsibility

10.1. Parents or legal guardians are responsible for the supervision and behavior of their children before and after swimming lessons.
10.2. Parents or legal guardians must ensure that participants arrive on time for their scheduled swimming lessons and are picked up promptly at the end of the lesson.
10.3. Parents or legal guardians should inform AA Swim School in advance if someone other than themselves will be picking up the participant.

11. Communication and Contact Information:

11.1. Participants and their legal guardians are responsible for providing accurate and up-to-date contact information during the registration process.
11.2. It is the participant's responsibility to notify AA Swim School promptly of any changes to their contact information.
11.3. AA Swim School will communicate important updates, notifications, and schedule changes primarily via email, but may also use other forms of communication such as text messages or phone calls.

12. Data Protection Policy

12.1. AA Swim School is committed to protecting the privacy and personal information of its customers/participants. This data protection policy outlines how we collect, use, store, and protect the personal data we collect during the enrollment process and throughout the course of our business relationship.
12.2. Personal Data Collection and Use:
12.2.1. AA Swim School will collect and process personal data from customers/participants for the purpose of enrollment, administration, and provision of swimming lessons.
12.2.2. The types of personal data we may collect include, but are not limited to, names, addresses, contact information, dates of birth, emergency contact details, and relevant medical information.
12.2.3. Personal data will only be collected and processed with the consent of the individuals, and for legitimate business purposes in accordance with applicable data protection laws and regulations.
12.2.4. We will not disclose personal data to third parties unless required by law or with the explicit consent of the individuals involved.
12.3. Data Security and Storage:
12.3.1. AA Swim School takes reasonable measures to protect the personal data we collect against unauthorized access, loss, or alteration.
12.3.2. Personal data will be stored securely and retained only for as long as necessary to fulfill the purposes for which it was collected or as required by law.
12.3.3. We employ industry-standard security protocols and procedures to safeguard personal data, including encryption, firewalls, access controls, and regular system updates.
12.4. Individual Rights:
12.4.1. Customers/Participants have the right to request access to their personal data, as well as the right to rectify or erase any inaccuracies.
12.4.2. Customers/Participants may also request the restriction or cessation of processing of their personal data, subject to legal requirements and contractual obligations.
